1. 协议双方与适用范围
本协议是你与 Unmistake 团队（以下简称「我们」）之间关于使用 Unmistake iOS 应用及相关服务（以下统称「本服务」）的约定。你通过 App Store 下载本应用，同时适用 Apple 的《许可应用最终用户许可协议》（Standard EULA）；两者不一致时，就你与我们之间的关系以本协议为准，但 Apple 依 EULA 享有的权利不受影响。Apple 不是本协议的一方，不对本服务承担责任或提供支持。
2. 服务内容
本服务提供拍题和文字题批改、分步讲解、错题本、复习练习、AI 辅导问答与小测、题库导入、学习周报等学习辅助功能。我们可能根据运营需要调整、增加或下线部分功能，并会尽量提前告知。
3. 账户
- 你可以通过 Apple、Facebook 或邮箱登录。请妥善保管登录凭证，对账户下的行为负责；发现账户被盗用请立即联系我们；
- 未登录时你只能浏览部分内容；批改、AI 辅导、练习和题库导入等 AI 功能需要登录后使用；
- 你应提供真实的学习档案信息。13 周岁以下（或你所在地法律规定的更高年龄）的用户须在父母或监护人同意和指导下使用，监护人验证完成前部分功能受限；
- 你可以随时在「我的 → 设置 → 注销账户」中注销。注销后账户和学习数据将被删除且无法恢复，未使用的积分和剩余的会员期一并失效；已在 App Store 开通的自动续费需你在系统设置中另行取消。
4. Unmistake PLUS 会员（自动续费订阅）
- 方案：PLUS 提供 1 个月、3 个月、12 个月三种自动续费方案，同属一个订阅组。具体价格以 App Store 显示的当地价格为准；
- 免费试用：符合条件的新用户可享 3 天免费试用（每个 Apple ID 在同一订阅组内仅限一次，由 Apple 判断资格）。试用结束前 24 小时内未取消的，将按所选方案自动扣费；
- 扣费与续费：确认购买时通过你的 Apple 账户扣费。订阅会在当前周期结束前 24 小时内自动续费，除非你在此之前关闭自动续费。续费价格与所选方案一致，价格变动时 Apple 会按其规则事先通知你；
- 管理与取消：在 iPhone「设置 → Apple 账户 → 订阅」中管理、切换或取消。取消后当前周期内的权益保留到期满，不再续费；在试用期内取消，试用剩余部分可能随即终止；
- 切换方案：同组方案之间的切换在下一个续费日生效；
- 退款：付款由 Apple 处理，退款请通过 Apple（reportaproblem.apple.com）申请，是否退款以 Apple 决定为准。退款后对应会员权益将被撤销；
- 恢复购买：更换设备或重装后，可在付费页点击「恢复购买」；
- 权益与合理使用：PLUS 会员的批改、AI 辅导提问、小测和练习「不限次」，但为保障服务稳定，每项功能设有正常学习不会触及的每日合理使用上限；题库导入每 30 天有页数上限。达到上限后当天暂停该功能，次日（UTC 时间）恢复。我们可能根据实际情况调整上限并在 App 内说明。
5. 免费额度与积分
- 通过 Apple 或 Facebook 登录的免费用户每天享有一定的免费批改、提问、小测和练习次数，具体以 App 内显示为准，按 UTC 时间每日重置，未用完的不累积；
- 积分是用于在免费额度用完后按次使用部分功能的虚拟计量单位，通过 App 内购买获得。积分不是货币，不能提现、转让、兑换现金或在账户之间转移；
- 积分不过期，但在你注销账户时失效。因功能失败未完成的操作，已扣积分会自动退回；
- 每次使用消耗的积分数以 App 内显示为准，我们可能调整并提前在 App 内公示。
6. AI 生成内容
- 批改、讲解、练习、辅导回答等由人工智能模型自动生成，可能存在错误、遗漏或不适合你的情况，仅供学习参考，不构成专业教学、考试或升学建议，不能替代老师的指导；
- 请勿将本服务用于考试作弊或违反学校规定的用途；
- 你提交的内容会按照《隐私政策》发送给第三方 AI 服务商处理。请勿在题目或对话中提交他人的个人信息或敏感信息；
- 如发现 AI 内容有误或不当，欢迎通过「帮助与反馈」告诉我们。
7. 你的内容
你上传的照片、文件、作答和对话（「你的内容」）的权利归你或原权利人所有。为提供本服务，你授予我们一项全球范围、非独占、免费的许可，在提供服务所必需的范围内存储、处理、传输和展示你的内容（包括发送给 AI 服务商）。该许可在你删除相应内容或注销账户后终止，法律另有要求的除外。你保证有权上传你的内容，且不侵犯他人的著作权或其他权利，例如未经授权上传受版权保护的整本教辅或试卷用于传播。
8. 行为规范
你不得：
- 上传违法、侵权、暴力、色情、歧视性或其他有害内容；
- 以脚本、机器人、批量注册、共享账户等方式滥用免费额度或会员权益；
- 逆向工程、破解、干扰本服务，或绕过额度和付费限制；
- 利用本服务从事违法活动或侵害他人合法权益。
违反上述规定的，我们有权视情节删除相关内容、限制功能、暂停或终止你的账户；已支付的费用按 Apple 规则和适用法律处理。
9. 知识产权
本服务的软件、界面设计、商标、图标、文字和我们提供的内容由我们或我们的许可方享有权利。我们授予你一项个人、非独占、不可转让、可撤销的许可，仅为个人学习目的在你拥有或控制的 Apple 设备上使用本应用。
10. 服务的变更、中断与终止
我们会尽力保证服务稳定，但可能因维护、升级、第三方服务（包括 AI 服务商）故障、网络问题或不可抗力导致服务中断。我们可能调整或终止部分功能；如终止整个服务，我们会提前在 App 内通知，并就已付费且未到期的会员权益按适用法律和 Apple 规则处理。
11. 免责与责任限制
在适用法律允许的最大范围内，本服务按「现状」提供，我们不保证服务无错误、不中断，也不保证 AI 内容准确、完整或适合特定目的。对因使用或无法使用本服务导致的间接、附带或后果性损失（包括成绩、升学结果等），我们不承担责任。我们对你承担的全部责任，以你在引起争议前 12 个月内为本服务实际支付的金额为限。适用法律不允许排除或限制的责任不受本条影响。
12. 协议的修改
我们可能修改本协议，并在 App 内或通过其他适当方式通知你。修改后继续使用本服务即视为同意修改后的协议；如不同意，你可以停止使用并注销账户。
13. 适用法律与争议解决
本协议的订立、执行和解释适用我们主要经营地的法律，但不排除你所在地法律赋予消费者的强制性保护。发生争议时，双方应先友好协商；协商不成的，提交有管辖权的法院解决。

Privacy Policy.
1. Parties and scope
These Terms are an agreement between you and the Unmistake team ("we", "us") for the Unmistake iOS app and related services (the "Service"). Because you download the app from the App Store, Apple's Licensed Application End User License Agreement (Standard EULA) also applies. Where the two differ, these Terms govern the relationship between you and us, without limiting Apple's rights under the EULA. Apple is not a party to these Terms and is not responsible for the Service or its support.
2. The Service
The Service offers grading of photographed and typed questions, step-by-step explanations, a mistake notebook, review practice, AI tutor questions and quizzes, question-bank import and weekly learning reports. We may change, add or retire features and will try to tell you in advance.
3. Your account
- You can sign in with Apple, Facebook or email. Keep your credentials safe; you are responsible for activity under your account. Contact us right away if it is compromised;
- Without signing in you can browse only some content. AI features such as grading, the tutor, practice and question-bank import require an account;
- Provide accurate learner-profile information. Users under 13 (or a higher age set by local law) may use the Service only with a parent's or guardian's consent and supervision; some features stay restricted until guardian verification is complete;
- You can delete your account at any time under Me → Settings → Delete account. Deletion permanently removes your account and learning data; unused credits and remaining membership time are forfeited. An App Store auto-renewal must be cancelled separately in iOS Settings.
4. Unmistake PLUS (auto-renewable subscription)
- Plans: PLUS is offered as 1-month, 3-month and 12-month auto-renewing plans in one subscription group, at the local price shown in the App Store;
- Free trial: eligible new subscribers get a 3-day free trial, once per Apple ID per subscription group as determined by Apple. Unless cancelled at least 24 hours before the trial ends, the selected plan is charged automatically;
- Payment and renewal: payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Renewals are charged at the plan's price; Apple notifies you of price changes under its rules;
- Manage and cancel: in iPhone Settings → Apple Account → Subscriptions. After cancelling, benefits continue until the end of the paid period and the plan does not renew. Cancelling during a trial may end the remaining trial immediately;
- Changing plans: switching between plans in the group takes effect at the next renewal date;
- Refunds: Apple handles payment, so request refunds from Apple at reportaproblem.apple.com. Apple decides whether to refund. Refunded purchases lose their benefits;
- Restore: on a new device or after reinstalling, tap Restore purchases on the paywall;
- Benefits and fair use: PLUS gives unlimited grading, tutor questions, quizzes and practice, subject to daily fair-use limits that normal study does not reach; question-bank import has a page limit per 30 days. When a limit is reached the feature pauses until the next UTC day. We may adjust these limits and will describe them in the app.
5. Free allowances and credits
- Free users who sign in with Apple or Facebook get a number of free gradings, tutor questions, quizzes and practice sessions per day, as shown in the app. Allowances reset daily at UTC midnight and do not carry over;
- Credits are a virtual unit, bought in the app, for using certain features after the free allowance is used up. Credits are not money and cannot be cashed out, sold, refunded for cash or moved between accounts;
- Credits do not expire but are forfeited when you delete your account. Credits spent on an operation that fails are returned automatically;
- The number of credits each use costs is shown in the app; we may change it with notice in the app.
6. AI-generated content
- Grading, explanations, practice and tutor answers are generated automatically by AI models and may be wrong, incomplete or unsuitable for you. They are a study aid only, not professional teaching, exam or admissions advice, and do not replace your teacher;
- Do not use the Service to cheat on exams or in ways your school prohibits;
- What you submit is sent to third-party AI providers as described in the Privacy Policy. Do not include other people's personal or sensitive information in questions or conversations;
- If you find AI content that is wrong or inappropriate, tell us through Help & feedback.
7. Your content
You or the original rights holders keep the rights in the photos, files, answers and conversations you submit ("Your Content"). To run the Service you grant us a worldwide, non-exclusive, royalty-free licence to store, process, transmit and display Your Content as needed to provide the Service, including sending it to AI providers. The licence ends when you delete that content or your account, unless the law requires otherwise. You confirm that you have the right to upload Your Content and that it does not infringe anyone's copyright or other rights, for example by uploading entire copyrighted workbooks or exam papers for redistribution.
8. Acceptable use
You must not:
- Upload illegal, infringing, violent, sexual, discriminatory or otherwise harmful content;
- Abuse free allowances or membership benefits with scripts, bots, mass sign-ups or shared accounts;
- Reverse engineer, crack or interfere with the Service, or bypass usage or payment limits;
- Use the Service for unlawful purposes or to harm others.
If you break these rules we may remove content, restrict features, or suspend or terminate your account. Payments are handled under Apple's rules and applicable law.
9. Intellectual property
We or our licensors own the software, design, trademarks, icons, text and content we provide. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, for your personal learning only.
10. Changes, interruptions and termination
We work to keep the Service available, but maintenance, upgrades, failures of third-party services (including AI providers), network problems or events beyond our control may interrupt it. We may change or end features. If we shut down the whole Service we will give notice in the app, and paid, unexpired membership will be handled under applicable law and Apple's rules.
11. Disclaimer and limitation of liability
To the fullest extent permitted by law, the Service is provided "as is". We do not warrant that it will be error-free or uninterrupted, or that AI content is accurate, complete or fit for a particular purpose. We are not liable for indirect, incidental or consequential losses arising from using or being unable to use the Service, including grades or admissions outcomes. Our total liability to you is limited to the amount you actually paid for the Service in the 12 months before the claim arose. Nothing here limits liability that cannot be limited by law.
12. Changes to these Terms
We may update these Terms and will notify you in the app or by other appropriate means. Continuing to use the Service after an update means you accept it; if you do not, stop using the Service and delete your account.
13. Governing law and disputes
These Terms are governed by the laws of the place where we principally operate, without removing mandatory consumer protections of the place where you live. The parties will first try to resolve any dispute amicably; failing that, it will go to a competent court.
